Terms and Conditions

MEMBERSHIP AGREEMENT – HUMBLE SPORT

This agreement is concluded between:

Humble Sport

and

Member:
The person who concludes a membership with Humble Sport, hereinafter referred to as the “Member.”

1. Term and Commencement 

1.1 Contract Duration The Member enters into a membership agreement for a fixed term of 12 months or 24 months.

The contract becomes effective on the start date selected by the Member during online registration or on-site registration.

1.2 Automatic Renewal
After the initial 12-month or 24-month period, the contract will automatically renew for an additional 12 or 24 months, unless the Member terminates the contract in accordance with the provisions of this agreement.

1.3 Notice Period
The Member may terminate the contract in writing with a notice period of at least 3 months before the end of the contractual term (or before the end of any renewal period).

2. Payment Terms 
2.1 Payment of Membership Fees Membership fees are collected monthly via SEPA direct debit from the bank account provided by the Member.

2.2 SEPA Direct Debit Authorization
The Member authorizes Humble Sport to debit the monthly membership fee from the provided bank account:

2.3 Administrative Fee
for Chargebacks In the event of chargebacks or failed transactions, an administrative fee of EUR 10 will be charged.

The Member will be notified of the chargeback in writing or by email.

2.4 Payment Default
In the event of payment default, Humble Sport reserves the right to deny access to its facilities until outstanding payments have been settled.

2.5 Costs for Failed SEPA Direct Debits If the SEPA direct debit fails due to insufficient funds or other errors, the following fees will be charged per failed transaction:

EUR 5 bank fee
EUR 5 administrative fee

These costs will be charged for each individual failed transaction.

Humble Sport is not responsible for ensuring that the Member maintains sufficient funds in the account.
Direct debits are executed on the 1st day of each month.

2.6 Change of Bank Details
If the Member changes the bank account (IBAN) after the contract has started, a processing fee of EUR 5 per change will be charged.

The Member is obliged to inform Humble Sport immediately of any change to bank details in order to prevent payment failures.

2.7 Responsibility for the Provided Bank Account
The Member confirms that they are authorized to use the bank account provided for the SEPA direct debit.
If a third-party account (e.g., parents, siblings, or other individuals) is provided, this shall be considered consent by the account holder for the debit of membership fees.

3. Termination and Contract End 
3.1 Member’s Right of Termination The Member may terminate the contract in writing with at least 3 months’ notice before the end of the 12- or 24-month term or any renewal period.

3.2 Termination by Mail or In Person
Termination must be made in writing and may be submitted: personally at the sports school by registered mail to the sports school address. Termination may also be submitted in text form (e.g., email).

3.3 Exceptional Cases
In the event of serious illness, injury, or relocation beyond a 50 km radius of the Humble Sport location, early termination may be granted by mutual agreement and upon submission of appropriate proof.

4. Liability 
4.1 Participation at Own Risk The Member participates in sports activities at their own risk and confirms that they are physically capable of participating in the training programs.

4.2 Liability Exclusion
Humble Sport assumes no liability for lost, stolen, or damaged personal belongings on the premises.

4.3 Damage to Facilities
The Member is liable for any damage caused to the facilities or equipment of Humble Sport.

4.4 Exclusion from Training
In the event of serious misconduct, Humble Sport reserves the right to exclude the Member from training without refund of paid fees.

4.5 Health and Liability Declaration
Mandatory Signature Signing the Health and Liability Declaration is a requirement for the commencement and continuation of membership.

By signing, the Member confirms that they are physically capable of participating in fitness and boxing training and assumes full responsibility for their health condition.

If the declaration is not signed, use of the facilities and participation in training occur entirely at the Member’s own risk.

The Member acknowledges that Humble Sport assumes no liability for health damages resulting from the absence of a signed declaration.

Failure to sign the declaration does not entitle the Member to early or extraordinary termination of the contract.

5. Boxing Training and Competitions 
5.1 Risks in Boxing Training 
The Member acknowledges that boxing training and participation in competitions involve additional risks, including but not limited to: bruises, sprains, fractures.

5.2 Personal Responsibility
The Member participates at their own responsibility and confirms that they are physically capable of engaging in these intensive activities.

5.3 Liability
Humble Sport shall not be liable for injuries or damages occurring during boxing training or competitions.
The Member agrees to hold Humble Sport harmless from any claims related to such injuries or damages.

6. House Rules 
6.1 Compliance with House Rules: 
The Member agrees to comply with the house rules of Humble Sport.

These rules can be viewed: at the sports school on the Humble Sport website

6.2 Consequences of Violations
Violations of the house rules may result in: temporary suspension from training termination of membership without refund

7. Data Protection 
7.1 Processing of Personal Data
The Member agrees to the collection, processing, and storage of personal data necessary for managing the membership. Processing is conducted in accordance with the General Data Protection Regulation (GDPR).

7.2 Member Rights
The Member has the right to request information about stored personal data request correction or deletion of their data

8. Digital Registration and Contract Conclusion 

Membership may be concluded online, digitally, or on-site.
By completing the online registration, providing personal data and bank details, and accepting the terms and conditions, a binding membership agreement is formed.

The absence of a physical or digital signature does not affect the validity of the contract, provided that the registration was made by the Member and the services are used.
Repeated payments without objection shall be considered confirmation of the existing membership agreement.

9. Prices and Price Adjustments 

9.1 Membership Prices
Prices for membership options (e.g., Basic, Premium) are displayed transparently on the website and on-site.

The Member selects the desired package during registration.

9.2 Price Changes 
Humble Sport reserves the right to adjust membership prices with at least 2 months’ notice before the new prices take effect.

10. Temporary Closure of the Sports School 

10.1 Reasons for Temporary Closure 
The sports school may be temporarily closed due to:

holidays
renovations
official measures (e.g., lockdowns)
other unforeseen circumstances

10.2 Membership During Closure 
During temporary closure, the membership contract remains valid and membership fees must continue to be paid if the closure is beyond the control of Humble Sport (e.g., government measures or force majeure).

Humble Sport may offer extended training times or alternative solutions as compensation.

11. Payment Default and Extraordinary 
Termination (§314 BGB) If the Member is in default with more than three consecutive monthly payments, Humble Sport may terminate the membership without notice in accordance with §314 German Civil Code (BGB).
In such a case, the full annual membership fee or the total contractual amount for the agreed term becomes immediately due.

Termination or discontinuation of usage by the Member does not release the Member from payment obligations.
Humble Sport reserves the right to enforce outstanding claims legally or through a debt collection agency.

Before exercising this right, at least one written reminder with a reasonable payment deadline will be sent by email.

If the case is transferred to a collection agency, the membership contract is considered automatically terminated, while all outstanding claims remain payable in full.

12. Amendments to the Terms and Conditions 
12.1 Changes Humble Sport reserves the right to amend or supplement these Terms and Conditions at any time.

Members will be informed in advance via email, website notice, or written communication.

12.2 Acceptance Continued 
use of Humble Sport services after the changes have been announced constitutes acceptance of the updated terms.

12.3 Obligation to Stay 
Informed Members are responsible for regularly reviewing the current Terms and Conditions on the website.

13. Minor Members 
Persons under the age of 18 are considered minors.Membership of a minor generally requires consent from a legal guardian (e.g., parents).

If a minor registers using the bank account of a parent, guardian, or third party, and membership fees are repeatedly debited without objection, this shall be considered implicit consent by the account holder.

If training services are used regularly and payments are made over an extended period without objection or chargeback, the membership is considered factually accepted.

Humble Sport reserves the right to request written parental consent at any time.

4. Severability Clause 
If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain unaffected.

The invalid provision shall be replaced by a valid provision that most closely reflects the economic intent of the original provision.

15. Jurisdiction 
To the extent legally permissible, the place of jurisdiction for all disputes arising from this contract shall be Koblenz, Germany.
