HUMBLE SPORT MEMBERSHIP CONTRACT
This contract is made between:

The person who signs up for membership at Humble Sport, hereinafter referred to as "Member."
1. Duration and Commencement
1.1. Contract Duration: The Member enters into a membership for a fixed term of either 12 months or 24 months. The contract comes into effect on the start date chosen by the Member during online registration or at the location.
1.2. Automatic Renewal:
After the initial 12 or 24 months, the contract automatically renews for another 12 or 24 months unless the Member cancels according to the terms of this contract.
1.3. Notice Period:
The Member may cancel the contract in writing at least 3 months before the end of the contract term (or before the end of any renewal).
2. Payment Terms
2.1. Payment of Membership Fees:
Membership fees are debited monthly by SEPA direct debit from the Member’s specified bank account.
2.2. Authorization for Direct Debit:
The Member authorizes Humble Sport to debit the monthly fee from the specified bank account:

2.3. Administration Fee for Chargebacks:
In case of chargebacks or failed debits, an administration fee of €17 will be charged. The Member will be informed in writing or by email about the chargeback.
2.4. Default:
If payment is overdue, Humble Sport reserves the right to deny access to the facilities until outstanding payments are settled.
2.5. Costs for Failed SEPA Direct Debits:
If a SEPA debit fails due to insufficient funds or other errors, the following fees will be charged per failed debit:
€5 bank fees
€5 administrative fees
These costs will be invoiced for each individual failed debit. Humble Sport is not responsible for ensuring the Member has sufficient funds. The debit occurs on the 1st of each month.
2.6. Change of Bank Account:
If the Member notifies a change of bank details after contract commencement, a fee of €5 per change will be charged. The Member agrees to inform Humble Sport immediately to avoid payment failures.
3. Termination and Cancellation
3.1. Member's Right to Cancel:
The Member can cancel in writing with at least 3 months' notice before the end of the 12- or 24-month term or any renewal.
3.2. Cancellation by Mail or In Person:
Cancellation must be in writing and can be delivered in person at the Sports School or sent by registered mail to the above address. Cancellation by email is not permitted.
3.3. Special Cases:
In cases of serious illness, injury, or relocation beyond 50 km from the Humble Sport location, early termination of the contract may be possible in consultation with Humble Sport and upon submission of appropriate proof.
4. Liability
4.1. Own Risk:
The Member participates in sports activities at Humble Sport at their own risk and confirms physical suitability for training programs.
4.2. Liability Disclaimer:
Humble Sport accepts no liability for lost, stolen, or damaged personal belongings on the premises.
4.3. Damage to Facilities:
The Member is liable for any damage caused to Humble Sport’s facilities or equipment.
4.4. Exclusion from Training:
For serious misconduct, Humble Sport reserves the right to exclude the Member from training without refund of fees paid.
4.5. Health and Liability Declaration – Signing Requirement and Liability:
Signing the health and liability declaration is a prerequisite for starting and continuing membership.
By signing, the Member confirms physical suitability for fitness and boxing training and assumes full responsibility for their health.
If the Member does not sign the declaration, use of the facilities and training participation is at the Member’s own risk. Humble Sport assumes no liability for health damages resulting from failure to sign.
Lack of signature does not entitle early or extraordinary contract termination.
5. Boxing Training and Competitions
5.1. Risks in Boxing Training:
The Member acknowledges that boxing training and competitions carry additional risks, including but not limited to bruises, sprains, or fractures.
5.2. Own Responsibility:
The Member participates in boxing training and competitions at their own risk and confirms physical fitness for these intense activities.
5.3. Liability:
Humble Sport is not liable for injuries or damages occurring during boxing training or competitions. The Member indemnifies Humble Sport from all claims related to such injuries or damages.
6. House Rules
6.1. Obligation to Comply:
The Member agrees to follow the house rules, which can be viewed on-site or on Humble Sport’s website.
6.2. Consequences of Violations:
Violations may result in temporary exclusion or membership termination without refund.
7. Data Protection
7.1. Collection and Processing:
The Member agrees to the collection, processing, and storage of personal data necessary to manage the membership, in accordance with GDPR.
7.2. Member Rights:
The Member may request information about stored data and have it corrected or deleted as needed.
8. Digital Acceptance
8.1. Online Registration and Payment:
By registering online and making payment on Humble Sport’s website or by signing this document on-site, the Member agrees to these general terms and conditions.
8.2. Registration Confirmation:
The contract will be signed digitally or in paper form, and confirmation will be sent by email.
9. Prices and Price Adjustments
9.1. Membership Prices:
Prices for membership options (e.g., Basic, Premium) are transparently displayed on the website and on-site. The Member selects the desired package during registration.
9.2. Price Changes:
Humble Sport reserves the right to change prices with at least 2 months’ notice before the new prices take effect.
10. Temporary Closure of the Sports School
10.1. Reasons for Temporary Closure:
If the sports school temporarily closes due to holidays, renovations, official measures (e.g., lockdowns or pandemic closures), or unforeseen circumstances, the membership remains valid, and the Member remains obligated to pay monthly fees.
11. Payment Default & Immediate Termination (§314 BGB)
1. If the member is in default with more than three consecutive monthly payments, Humble Sport is entitled to terminate the membership agreement without notice in accordance with § 314 of the German Civil Code (BGB).
2. In this case, the full annual membership fee (or the total amount of the contractually agreed term) becomes due immediately.
3. A termination or discontinuation of use by the member does not release them from their payment obligation. Humble Sport explicitly reserves the right to pursue outstanding payments legally or through a debt collection agency.
4. Before exercising this right of termination, at least one written reminder with a reasonable deadline will be sent by email.
5. If the case is handed over to a collection agency, the membership agreement is considered automatically terminated without the need for further reminders or deadlines. All outstanding claims remain fully enforceable.
12. Amendments to the Terms and Conditions
12.1. Humble Sport reserves the right to change or supplement these terms at any time. Changes will be communicated to the Member in due time by suitable means (e.g., email, website, or in writing).
12.2. Continued use of Humble Sport’s services after notification of changes constitutes acceptance by the Member.
12.3. The Member is obliged to regularly check the current terms and conditions on Humble Sport’s website.
